Abstract

In the European political discourse, it is a common view that the state enjoys a broad sovereign right to exclude irregular immigrants, who reside on its territory without formal consent, from the enjoyment of membership-specific rights. This thesis questions that view and investigates the gap between human rights considerations and securitization in the EU through the analysis of its external migration management framework. By focusing on the social and legal situation of non-returnable third-country nationals in Germany, it will also assess if the legal recognition of such migrants as a category may be a viable solution in addressing the flaws present in the Return Directive.
